Terms & Conditions

These terms govern your use of Nightshift and any service you order from it.

1. Who you are contracting with

Nightshift is operated by Rebecca Wilson, trading as Nightshift ("we", "us", "our"). When you order a service, you are contracting with Rebecca Wilson.

2. Acceptance

By creating an account, placing an order, or otherwise continuing to use the service, you agree to these terms. You confirm you are of legal age to enter a contract and, if ordering for an organisation, that you have authority to bind it.

3. What we provide

Nightshift sells fixed-scope, AI-generated deliverables (for example copy packs, outreach sequences, and content plans) produced from the brief you submit, plus optional monthly memberships that include a defined volume of orders. Deliverables are generated automatically and emailed to you with a private link.

4. Your account and information

You are responsible for keeping your credentials confidential and for all activity under your account, and for providing accurate information and keeping it up to date.

5. Acceptable use

You must not use the service to:

  • break any law or regulation, or facilitate fraud, spam, or deceptive practices;
  • generate illegal content, sexual content involving minors, hate speech, harassment, deepfakes or impersonation, malware, or content designed to deceive or defraud;
  • infringe anyone's intellectual property, privacy, or other rights;
  • attempt to jailbreak, bypass, or manipulate our safety controls, model prompts, or usage limits;
  • interfere with the security or integrity of the service — malware, probing, scanning, automated scraping, or unauthorised access attempts;
  • reverse engineer the service, resell or redistribute it as your own platform, or circumvent technical limits.

6. AI output, inputs, and accuracy

You are responsible for the briefs and materials you submit, for having the rights to submit them, and for how you use the output. AI-generated output may contain inaccuracies and must be reviewed before you rely on it. It is not legal, financial, medical, or other regulated professional advice, and should not be used in regulated contexts without qualified human oversight.

You keep the rights in the material you submit and grant us a limited licence to host and process it solely to provide the service. Subject to payment, you may use the deliverable for your own commercial purposes. Similar output may be generated for other customers from similar briefs.

If you believe output or submitted content infringes your rights, contact us and we will review and, where appropriate, remove it. We may remove, restrict, or refuse content and outputs, and we may suspend accounts for repeated or serious infringement or misuse.

7. Our intellectual property

We retain all rights in the Nightshift platform, its software, pipelines, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the service within the plan you purchased.

8. Payments, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, currency, renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Memberships renew monthly until cancelled; cancelling takes effect at the end of the paid period, and upgrades take effect immediately while downgrades take effect at the next renewal. 9. Service level

We work to keep Nightshift available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, model provider outages, and other interruptions may occur.

10. Warranties and liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or loss of goodwill. Our total aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

You will indemnify us against claims arising from your submitted content, your use of outputs, or your breach of these terms.

11. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time and cancel a membership through Paddle. On termination, your access to the platform and stored deliverables ends; where lawful and practical we will give you a reasonable window to export your deliverables before deletion.

12. Changes, law, and disputes

We may update these terms; the version published here is the current one, and continued use after an update means you accept it. You may not assign your rights without our consent; we may assign ours in connection with a merger, acquisition, or sale of the business. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the seller's jurisdiction, and its courts have exclusive jurisdiction over disputes, without affecting your mandatory local consumer rights.
